These Terms of Service ("Terms") govern your access to and use of Dispatcher365 websites, applications, and related services. By using our services, you agree to these Terms. Please read them carefully.
Acceptance of Terms
By accessing or using Dispatcher365, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must not use our services. We may update these Terms from time to time; continued use after changes constitutes acceptance of the revised Terms.
Description of Services
Dispatcher365 provides dispatching services, transportation management software, and related tools for carriers, dispatch companies, and logistics teams. Features and availability may vary by plan, region, and account type.
We reserve the right to modify, suspend, or discontinue any part of the services with reasonable notice where practicable.
Accounts and Eligibility
- Registration: You must provide accurate information when creating an account and keep it current.
- Security: You are responsible for safeguarding credentials and for all activity under your account.
- Eligibility: You must be authorized to act on behalf of your organization and comply with applicable motor carrier and freight regulations.
Acceptable Use
You agree not to:
- Use the services for unlawful purposes or in violation of FMCSA or other applicable regulations.
- Attempt to gain unauthorized access to systems, data, or accounts.
- Interfere with or disrupt the integrity or performance of the platform.
- Upload malicious code or misleading load, carrier, or driver information.
Intellectual Property
Dispatcher365 and its licensors own all rights in the platform, branding, software, and documentation. You receive a limited, non-exclusive license to use the services for your internal business operations during an active subscription or service agreement.
You retain ownership of your business data. You grant us a license to process that data solely to provide and improve the services.
Disclaimers and Limitation of Liability
Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, Dispatcher365 shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data arising from your use of the services.
Our total liability for any claim relating to the services shall not exceed the amounts paid by you to Dispatcher365 in the twelve (12) months preceding the claim.
Termination
You may stop using the services at any time. We may suspend or terminate access for breach of these Terms, non-payment, or legal or security reasons.
Upon termination, your right to use the services ends. Provisions that by nature should survive (including payment obligations, disclaimers, and limitation of liability) will survive.
Governing Law and Contact
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Disputes shall be resolved in courts located in Delaware, unless otherwise required by applicable law.
